These Terms and Conditions of Sale ("Terms") govern the contractual relationship between SARL Djerba Sensations, a tourist activity booking platform based at 4116 Djerba Midoun, Tunisia, and any person ("the Customer") wishing to book a tourist activity offered on the website djerba-sensations.com. Any booking made on the website implies full and unreserved acceptance of these Terms.
These Terms apply to all bookings for activities, excursions and packages offered by Djerba Sensations, whether the booking is made online on the website, via WhatsApp, or through any other means of direct contact.
Djerba Sensations offers tourist activities on the island of Djerba and in southern Tunisia: water activities (jet ski, catamaran, parasailing, towed buoys, sea outings), outdoor activities (quad biking, buggy, dromedary rides, horse riding, horse-drawn carriage), excursions on the island of Djerba, excursions off the island (desert, southern Tunisia), as well as packages combining several activities.
Each activity has its own presentation page detailing the duration, price, minimum age, level required, equipment provided, and pick-up arrangements (location, time). This information forms an integral part of the contract concluded with the Customer.
Bookings are made online on the website, via the booking engine. The Customer must provide: their contact details (first name, last name, email, phone), the number of participants, their place of accommodation (for transfer arrangements), as well as any additional information useful for the proper conduct of the activity.
The booking is confirmed by sending a confirmation email, and/or a WhatsApp message specifying the exact pick-up time, generally sent the day before the activity.
As Djerba Sensations provides services (activities and excursions) rather than physical goods, there is no physical shipping. "Delivery" consists of the provision of the booked service, at the date, time and pick-up location agreed at the time of booking, as confirmed by email and/or WhatsApp.
Prices are shown in euros (€) on each activity page. They may be changed at any time, but the price applicable is the one in effect at the time of booking.
Payment is made in full at the time of booking, by card via the secure payment gateway Flouci (Kaoun SARL, Tunisia). No partial deposit is offered: payment of the full amount due is required to confirm the booking.
Prices shown on the website are displayed in euros (€) for reference. Payment is processed in Tunisian dinars (TND), in accordance with the regulations applicable to service providers established in Tunisia. The exact amount in TND is displayed to the Customer on the secure payment page before final payment confirmation. Currency conversion or international transaction fees may be applied by the Customer's bank, independently of Djerba Sensations.
No banking data is collected or stored by Djerba Sensations; payment is processed directly by our payment partner.

In accordance with European regulations applicable to distance selling, the 14-day right of withdrawal does not apply to leisure services to be provided on a specific date or during a specific period. As the activities offered by Djerba Sensations fall into this category, the Customer does not benefit from a right of withdrawal after booking — the cancellation terms set out in Article 5 above apply instead.
Each activity is subject to specific conditions specified on its presentation page (minimum age, level required, medical contraindications, wearing of safety equipment). It is the Customer's responsibility to check that participants meet these conditions before booking.
For safety reasons, the consumption of alcohol or illicit substances is strictly prohibited before and during the practice of any activity. Djerba Sensations reserves the right to refuse access to an activity to any person whose condition would not allow safe participation, without refund.
The activities offered inherently involve risks associated with outdoor sports and leisure activities. Djerba Sensations acts as a booking intermediary between the Customer and the partner service providers who physically operate each activity (activity centres, boat owners, instructors, guides).
Each partner service provider holds basic insurance covering the risks associated with the normal practice of the activity it operates, in accordance with applicable Tunisian regulations. The Customer must strictly follow the safety instructions given by the guide or instructor on site.
Djerba Sensations cannot be held liable for damage resulting from the Customer's failure to follow safety instructions, a false declaration regarding their state of health, an act attributable to the partner service provider operating the activity, or a case of force majeure.
In the event of force majeure (adverse weather conditions, natural disaster, administrative decision, etc.) making it impossible to carry out the activity, Djerba Sensations will inform the Customer as soon as possible and offer a postponement or a full refund, in accordance with Article 5.
Any complaint should be addressed as a priority by email to contact@djerba-sensations.com or via WhatsApp, to allow for a quick amicable resolution.
Failing an amicable resolution, these Terms are governed by Tunisian law, and any dispute falls within the jurisdiction of the Tunisian courts, without prejudice to any mandatory rights that the consumer Customer may benefit from under the law of their country of residence within the European Union.
Any booking made on the website djerba-sensations.com, via WhatsApp or through any other channel, implies full and unreserved acceptance of these Terms and Conditions of Sale.
